Garrett P. Swartwood
Garrett Swartwood’s primary practice is in the areas of civil trials, commercial litigation and business and real estate law, with an emphasis on commercial collections and judgment recovery, construction litigation, landlord-tenant and real estate litigation, contract and lease preparation, business disputes and complex litigation. Garrett has extensive experience in both state and federal trial courts, bankruptcy courts and appellate courts. Garrett has represented clients in arbitration and administrative proceedings and before Special Masters. He is a frequent lecturer to attorneys and trade groups on subjects related to his areas of practice.

Garrett has successfully handled numerous bench and jury trials in state and federal courts. He has also handled many cases on appeal. Among Garrett’s recent representative matters, he has:
- Collected over $1,000,000 in outstanding accounts receivable for various local, regional and national businesses;
- Successfully defended general contractor in construction lawsuit involving claims in excess of $1,000,000, while obtaining at trial a judgment of several hundred thousand dollars;
- Successfully defended developer at trial in case involving claims by general contractor;
- Successfully represented directors and officers in establishing insurance rights in multi-million dollar bankruptcy litigation;
- Successfully defended architect in construction litigation through week-long jury trial;
- Successfully handled several appeals before the Tennessee Court of Appeals;
- Defended property owners in claims under the federal Fair Housing Act;
- Represented contractors and property owners in various contract and lease negotiations;
- Represented lenders and borrowers in foreclosures, deficiency judgment actions, and work-outs;
- Represented numerous lenders and creditors in bankruptcy; and
- Represented commercial property owners in various evictions and lease enforcements.
Before joining the firm, Garrett practiced law and led Marines as an officer in the U.S. Marine Corps. He is active in the Knoxville Bar Association. He lives in Farragut, Tennessee, with his wife and three children. When not practicing law, he enjoys the many outdoor and sportsman’s activities available in East Tennessee with his family.
